User Agreement

1. Introduction & Acceptance of Agreement

This User Agreement ("Agreement") is a legally binding contract between you ("User", "you", "your") and Seetharkundu Herbal Plantations & Health Resorts Pvt. Ltd. ("the Company", "we", "us", "our"), operating as Seetharkundu Resorts, in respect of your use of our website at www.seetharkunduresorts.com ("the Website") and any services availed at or through the Resort.

This Agreement functions as the master umbrella agreement binding together all policies published by Seetharkundu Resorts. By accessing the Website, making a reservation, or using our services in any capacity, you confirm that you have read, understood, and unconditionally agree to be bound by this Agreement and all associated policies listed in Section 2 below.

This Agreement is published and enforceable under the Indian Contract Act, 1872, the Information Technology Act, 2000, the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and other applicable laws of India.

If you do not agree with any part of this Agreement or any associated policy, you must immediately cease use of the Website and refrain from availing our services.

2. Associated Policies & Legal Framework

This Agreement is to be read in conjunction with the following policies, all of which form an integral part of the binding legal framework between you and the Company:

Community Guidelines Sets standards of conduct for guests on our premises and users engaging with us online, including photography, noise, and social media rules
Grievance Redressal Policy Defines how to submit, escalate, and resolve complaints - including statutory consumer forum and Data Protection Board pathways

In the event of any conflict between this Agreement and any associated policy, the more specific policy document governing the relevant subject matter shall prevail.

3. Eligibility & Capacity to Contract

  • You must be at least 18 years of age and legally competent to enter into a binding contract under the Indian Contract Act, 1872 to use the Website or make a reservation.
  • If you are making a booking on behalf of a group, family, or organisation, you confirm that you have the authority to bind all members of that group to this Agreement.
  • Bookings made on behalf of groups that include minors remain the sole responsibility of the adult making the reservation. The Company shall not be liable for the conduct or safety of unsupervised minors.
  • Use of the Website by individuals who do not meet these eligibility criteria is prohibited. The Company reserves the right to cancel any booking made in breach of this clause without refund.

4. User Responsibilities

By using the Website or availing our services, you agree to:

4.1 Accuracy of Information

  • Provide truthful, accurate, and complete information when making bookings, submitting enquiries, or communicating with the Resort.
  • Promptly notify us of any changes to your contact or booking details.
  • Present valid government-issued photo identification at check-in as required under applicable police verification regulations.

4.2 Conduct & Compliance

  • Respect and comply with resort rules, staff instructions, and safety guidelines at all times during your stay.
  • Abide by our Community Guidelines both on-premises and in online interactions with the Resort.
  • Comply with all applicable laws of India and the State of Kerala during your visit and in your online use of the Website.
  • Treat fellow guests, resort staff, local communities, and the natural environment with courtesy and respect.

4.3 Website Use

  • Use the Website only for lawful, personal, non-commercial purposes.
  • Not attempt unauthorised access to any part of the Website, its servers, or associated systems.
  • Not introduce malicious code, conduct denial-of-service attacks, or engage in any activity that disrupts or compromises the Website.
  • Not submit false, fraudulent, or duplicate booking requests.

4.4 Session & Booking Responsibility

  • You are responsible for maintaining the confidentiality of any booking reference numbers, login credentials, or transaction details associated with your reservation.
  • You accept full responsibility for all activities conducted through your session on the Website or associated with your booking details.
  • Notify us immediately at info@seetharkunduresorts.com if you suspect any unauthorised use of your booking information.

5. Consent to Data Processing

By using the Website or making a reservation, you acknowledge and consent to the collection and processing of your personal data as described in our Privacy Policy, including:

  • Processing your booking and identity information for reservation management;
  • Sharing government-issued ID details with statutory authorities as required under Indian police verification regulations;
  • Using contact details to send booking confirmations, invoices, and service-related communications;
  • Processing payment information through PCI-DSS compliant third-party payment gateways.

You may withdraw consent for non-essential data processing (such as marketing communications) at any time by contacting us at info@seetharkunduresorts.com. Withdrawal of consent will not affect the lawfulness of any processing carried out prior to withdrawal.

6. Intellectual Property

All content on the Website - including but not limited to text, photographs, graphics, videos, logos, icons, page layouts, resort descriptions, and branding materials - is the exclusive property of Seetharkundu Herbal Plantations & Health Resorts Pvt. Ltd. or its licensed content providers, and is protected under:

  • The Copyright Act, 1957
  • The Trade Marks Act, 1999
  • The Information Technology Act, 2000
  • Other applicable Indian intellectual property laws

6.1 Permitted Use

  • You may view and access Website content for personal, non-commercial reference only.
  • You may share links to our Website pages for informational purposes.

6.2 Prohibited Use

  • Copying, reproducing, distributing, or republishing any Website content without our prior written consent;

8. Disclaimer of Warranties

The Website and all information and Services provided through it are offered on an "as is" and "as available" basis. To the fullest extent permitted by law, the Company makes no warranties, express or implied, including but not limited to:

Guests are encouraged to confirm all booking details directly with the Resort by phone or email before travelling.

9. Limitation of Liability

To the fullest extent permitted under the laws of India, the Company shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from:

  • Your use of, or inability to access, the Website or its Services;
  • Reliance on any information published on the Website;
  • Unauthorised access to your personal data or booking information;
  • Technical failures, outages, or interruptions of the Website;
  • Loss of personal belongings during a stay at the Resort;
  • Personal injuries arising from voluntary participation in outdoor or adventure activities, subject to our duty of care obligations;
  • Delays or disruptions caused by weather, transport failures, or force majeure events.

Nothing in this Agreement limits or excludes liability for personal injury or death caused by the Company's negligence, or for any other liability that cannot be excluded under applicable Indian law.

Where liability cannot be excluded, the Company's total aggregate liability to you shall not exceed the amount paid by you for the specific booking or service giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its directors, officers, employees, agents, and affiliates from and against any claims, liabilities, losses, damages, penalties, and legal expenses (including reasonable attorney fees) arising from:

  • Your breach of this Agreement or any associated policy;
  • Your violation of any applicable law or third-party rights;
  • Any content you submit, post, or transmit through the Website or our digital channels;
  • Your conduct during your stay at the Resort that causes harm to other guests, staff, or property.

11. Modification of Agreement

The Company reserves the right to amend, update, or replace this Agreement at any time. The revised Agreement will be published on this page with an updated "Last Updated" date.

For material changes, we will make reasonable efforts to notify you (e.g., via email or a prominent notice on the Website). Your continued use of the Website or services after the publication of any changes constitutes your acceptance of the revised Agreement.

12. Termination

The Company reserves the right, at its sole discretion and without prior notice, to:

  • Suspend or terminate your access to the Website or any of its Services;
  • Cancel bookings found to be in violation of this Agreement or any associated policy;
  • Pursue appropriate legal remedies for any unlawful or harmful use of the Website.

Provisions of this Agreement that by their nature should survive termination - including intellectual property rights, indemnification, disclaimer of warranties, limitation of liability, and governing law - shall continue to apply after termination.

13. Grievance Redressal

Any complaint, concern, or dispute arising from your use of the Website or services should first be submitted to our Grievance Officer in accordance with our Grievance Redressal Policy.

If your complaint is not resolved through internal channels, you have the right to approach the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019, or the Data Protection Board of India under the Digital Personal Data Protection Act, 2023. 14. Governing Law & Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of India. Any dispute, claim, or controversy arising out of or relating to this Agreement - or the breach, termination, enforcement, interpretation, or validity thereof - shall be subject to the exclusive jurisdiction of the courts at Palakkad, Kerala, India.

Prior to initiating any formal legal proceedings, parties agree to make a good-faith effort to resolve disputes through our internal Grievance Redressal process.

15. Severability

If any provision of this Agreement is found by a court of competent jurisdiction to be unlawful, void, or unenforceable, that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of the remaining provisions, which shall continue in full force and effect.

16. Entire Agreement

This User Agreement, together with our Terms & Conditions, Terms of Service, Privacy Policy, Community Guidelines, and Grievance Redressal Policy, constitutes the entire agreement between you and the Company with respect to your use of the Website and services, and supersedes all prior or contemporaneous discussions, representations, or agreements relating to the same subject matter.
